Read this before considering a property
Property transactions can involve substantial financial and legal commitments. Cross-border, off-plan and agricultural leasehold transactions carry additional risks.
This notice is general information. It is not legal, tax, financial, technical or investment advice. Obtain independent advice in each relevant country before signing documents, paying money or making a commitment.
General property risks
Availability, pricing, specifications and completion dates may change. Nothing on this website constitutes an offer or guarantee.
Before proceeding, independently verify:
- the identity and authority of every contracting party;
- title, ownership and any mortgages, restrictions or competing rights;
- planning, construction, environmental and operating approvals;
- the exact property or leasehold interest being acquired;
- all prices, taxes, duties, service charges and continuing costs;
- how money will be held, applied and protected;
- cancellation, default and dispute procedures; and
- the practical enforceability of your rights.
Property values and market demand may rise or fall. A buyer or leaseholder may be unable to resell, assign or recover the amount paid.
Cross-border transactions may also expose you to exchange-rate movements, transfer restrictions, differing legal systems and additional tax or reporting duties.
Obsidian Crown
Obsidian Crown is a proposed collection of 49 off-plan homes in Tbilisi, Georgia. Pernefer Group LLC is the seller. Sales are not open.
An off-plan home is considered before construction and completion are final. Relevant risks may include:
- delay, redesign or failure to complete;
- changes to plans, dimensions, finishes, shared areas or views;
- permits or approvals not being granted or maintained;
- differences between visual material and the completed property;
- additional completion, ownership or maintenance costs;
- the seller or another project participant failing to perform;
- restrictions on cancellation, assignment, resale or finance; and
- money paid before completion being difficult to recover.
A digital or visual presentation is illustrative. It is not a completed-property inspection or a contractual specification.
Before committing, obtain independent Georgian legal advice and review the final plans, title information, approvals, construction arrangements, payment protections, completion tests, defect remedies and transaction documents.
Sekhet Nebu Farms
Sekhet Nebu Farms is a managed agricultural leasehold involving rice in the Bono East Region of Ghana. Sekhet Nebu Farms is the operator.
A leasehold is a time-limited right governed by its documents and applicable law. It is not the same as unrestricted ownership of land.
Relevant risks may include:
- uncertainty or disputes concerning title, boundaries, lease rights or land use;
- restrictions on transfer, assignment, occupation or use;
- crop failure, pests, disease, weather, flooding, drought or fire;
- water, soil, infrastructure and environmental constraints;
- changing input, labour, transport and commodity costs;
- dependence on the operator and other service providers;
- changes in law, tax, permits or agricultural policy;
- interruptions to planting, harvesting, storage or sale;
- no buyer being available for produce or the leasehold interest; and
- income or capital not being returned as expected.
A defined parcel or record of agricultural activity does not itself establish title, production, income, insurance cover or a right to particular crops or proceeds.
Before committing, obtain independent Ghanaian legal, tax, land and agricultural advice. Verify the lease, title, boundaries, term, renewal and termination rights, permitted use, operating arrangements, fees, insurance, crop rights, reporting, payment arrangements and remedies for non-performance.
No promised return
No property or agricultural outcome is certain. Illustrations, projections, anticipated harvests or expected values should not be treated as guarantees.
Do not commit money that you cannot afford to lose or leave unavailable for the full expected transaction period.
Independent advice
Use advisers who act for you and are independent of the seller, operator, marketer and other project participants.
You may need advice from:
- a lawyer qualified where the property is located;
- a South African lawyer for South African legal and regulatory issues;
- a tax adviser familiar with every relevant country;
- an independent surveyor, engineer or technical adviser; and
- an appropriately authorised financial adviser if the arrangement is being considered for investment purposes.
Do not rely only on website content or information supplied by a person who benefits from the transaction.
